HC issues notice to Government

Suspended SSP, others produced in Court

AMANDEEP MURDER CASE

Jammu, Nov 4: The High Court today issued notice to the State Government in response to petition filed by Choudary Nagar Singh, accused in the Amandeep Singh murder case, seeking quashment of Chief Judicial Magistrate’s order in which proclamation has been issued against Rakesh Kumar, Choudhary Nagar Singh alias Nago and Choudhary Jaggar Singh.
The petition submitted that the CJM order of October 20, 2009, on some unknown application was absolutely wrong, illegal and against the provisions of law. It says it is violative of the constitutional and other legal rights of the petitioners. Besides, it said, being perverse and having been issued merely on the asking of the SIT so as to oblige the police and the same is not sustainable in law.
The Court issued notice to the State Government directing it to file objections in the case.
Meanwhile, the police today produced suspended SSP Jammu Manohar Singh, former SHO Sultan Mirza, Sub-Inspector Satnam, Royal Singh, Sarwar Hussain Bukhari and Raj Singh before the Principal Sessions Judge.
The Principal Sessions Judge Jammu, BL Bhat, adjourned the case and fixed November 16 for arguments, directing the police to produce all the accused persons on that day.
Meanwhile, Sarwar Hussain Bukhari, Ballistic Expert FSL Jammu, and Raj Singh of FSL Jammu filed their bail applications.
The judge directed the special public prosecutor to file objections in the bail applications.
Special Judge Anti-corruption Jammu, JR Kotwal, adjourned the bail application case of former SSP Jammu, then SHO Gandhi Nagar and fixed the date for arguments on November 9.
