At Court, witness swears he receives threats

ROMANA MURDER CASE FOLLOW UP

SAMAAN LATEEF

Srinagar, Apr 20: In Romana murder case, a witness Tuesday said he was receiving threats for deposing against the two accused.
Muhammad Umar, a witness of hit-and-run case filed an application before the Court saying he is receiving threats and is being forced not to depose against the accused involved in the murder of the teenager who was crushed to death when out for tuitions last year.
Umar said somebody met him personally and asked him not to appear before the Court against the accused.
Earlier, the defense lawyers objected to recording of the statement by Umar arguing he was witness number three and cannot depose before witness number one and two.
“First two witnesses should depose first than the third witness,” defense counsel argued. He refused to cross examine the witness and said the prosecution had to fix the session if he wanted to present Umar as first witness.
After hearing the arguments, Principal District and Sessions Judge Gous-u-Nisa observed it was "discretion of the prosecution to decide which witness is to be produced before the Court.”
The court later deferred the deposition in the case till April 23 for cross examination of the witness.
On March 13, this year, prosecution filed a chargesheet against the two accused Shoaib Daryeel son of Muhammad Ashraf Daryeel of Nowhatta and Obaid Ahmed Khan son of Zahoor Ali Khan of Bulbul Bagh Barzulla charging the duo for murder under Section 302, 294, 201 and 34 RPC.
The prosecution in the chargesheet had pleaded that the two had killed Romana Javed, 11th class student on May 3 last year near Parray pora area of Srinagar after they intercepted her outside a tuition centre at Barzulla.
The youth travelling in black color Alto Car (JK01H-5758) had passed indecent remarks towards the girl. Then they threw a chit of paper towards her with phone numbers written on it. However, she did not pay any attention to it and did not pick it up.
The chargesheet also said that the accused got enraged and crushed the girl under their vehicle, killing Romana on spot.
Later talking to Greater Kashmir Public Prosecutor Abdul Aziz Teli said: “Muhammad Umar is witness number 3 in the case and I presented him before the court today. He filed final application supported by an affidavit praying that he had received threats not to record his statement.”
