GOVT ISSUES INSTRUCTIONS TO REGULATE TRANSFER POLICY

Jammu, April 26: Government has issued instructions to regulate transfer policy to Gurez, Dachan, Marwah and Wadwan areas directing for strict compliance by all administrative departments, heads of departments and district heads with immediate effect, an official spokesman said in a statement here on Monday.
Under the transfer policy, the Deputy Commissioners of Bandipore and Kishtwar would formulate timetable for transfers and postings in Gurez, Dachan, Marwah and Wadwan areas and furnish it directly to the concerned heads of departments in respect of non-gazetted employees and to the administrative secretaries in respect of gazetted officers by December 31 each year indicating full details about the posting, stay etc of each employee, he said.
The employees joining their posting on or before June 30 in these areas shall be deemed to have completed their tenure of two years and those joining after July 1 shall have to serve for another winter. The employee having completed two years service in these areas shall not be transferred to Ladakh unless he has spent two years of service in another area. The transferee shall not be relieved till his reliever joins. The employees transferred to these areas shall avail normal joining time, the spokesman said.
Notwithstanding any such powers vested under JK CSR or any other delegation, no Head of Department (HoD) shall transfer any post from Gurez, Dachan, Marwah and Wadwan to any other office outside these areas for any purpose except after obtaining prior written approval of the administrative department, he added.
The transferring authority shall ensure that orders are issued by or before April 30 each year and the transferee relieved on May 31 in any case unless he is ordered in public interest to be relieved and join his new posting earlier. Even if no order of relieving is given in the transfer order, the HoD and head of concerned office shall be personally responsible to ensure that such transferee is relieved before May 31. In the absence of any written instructions to the contrary, the transferred employee shall handover charge/sign his departure report positively by or before May 31.
There will be no upper age limit for claiming exemption from posting in Gurez, Dachan, Marwah and Wadwan areas and the transfer/posting orders shall be issued without giving any formal advance notice. The only ground for consideration of transfer/posting would be employee’s own serious illness and serious illness of his spouse. The employee has to apply to standing medical board in such a situation by himself.
The junior most employee having minimum three years service in the department shall ordinarily be posted to Gurez, Dachan, Marwah and Wadwan and no such experience shall be required for direct recruits posted for the first time, similarly, fresh promotees may be transferred to these areas on first posting after promotion to the higher scale or in their own pay and grade. Any employee volunteering for transfer to these areas may also be considered for such posting.
Employees on completion of their tenure in these areas as far as practicable be posted in their home districts. The district heads have been directed that they shall, mutatis mutandi follow the above instructions on posting of staff in Gurez, Dachan, Marwah and Wadwan areas in respect of posts falling under district cadre.
