Government opposes further probe in Jaleel Andrabi case

Srinagar, Apr 2: The state government today opposed the application moved by the family members of Jaleel Andrabi seeking further investigation in his killing.
The government cited the delay of years in moving the application by the family as ground for its opposition.
The Chief Judicial Magistrate Muhammad Ibrahim Wani asked the counsels to remain present on Saturday to assist the court with legal position in the case after argument remained inconclusive today. The court kept the arguments open after government counsel opposed the provision of further investigation claim of family members on the grounds of ‘excessive delay.’
The family members of Jaleel Andrabi had filed an application through their counsels Mir Hafizullah and Arshad Andrabi seeking further investigation in the case.
Arguing in favor of the application, Advocate Arshid, who is also the brother of Jaleel Andrabi, said that there was a conspiracy hatched by the state to shield the accused Major Avtar Singh, the main accused in the killing, since the charge sheet was presented before the court. He said government should be asked whose orders Major Avtar Singh followed to kill Jaleel. Both the counsels prayed before the court for directions to the police to further investigate the killing.
The government counsel said further investigation comes under the domain of police and cannot be claimed in the court. “Further investigation into the matter as claimed by applicant after lapse of eight years is not justifiable. They could have agitated for this relief earlier when the charge sheet was presented before the court,” he submitted.
He said that further investigation is the prerogative of the High Court, which has constituted the Special Investigation Team to probe into the killing.
