HC to hear case regularly
ELECTION PETITION AGAINST MP, RS MEMBERS

Jammu, Dec 29: A special single bench (Election Tribunal) of Jammu and Kashmir High Court will be hearing the two election petitions, challenging the election of MP, Choudhary Lal Singh from Doda-Udhampur constituency and four Rajya Sabha members from the state-on regular basis.
The Election Petitions have been filed by National Panthers Party chief, Prof Bhim Singh. He has challenged the election of Choudhary Lal Singh, Congress Member Parliament on the ground that “in the nomination form Singh had written his party as INC, whereas the fact is that there was no such party registered with the Election Commission of India.”
Similarly, Prof Bhim Singh has also challenged the election of four RS Members, Ghulam Nabi Azad, Dr Farooq Abdullah, Prof Saif-ud-Din Soz and Shafi Uri on the ground that “all of them were elected after ECI issued three separate notifications (instead of single notification) for the elections only to benefit the elected members.”
Hearing the petitions, Justice Sunil Hali, who has been appointed as Election Tribunal by the court, today directed to list the petitions before him on regular basis, Prof Bhim Singh claimed. He said the petition with regard to the election of Choudhary Lal Singh would now be listed for hearing on December 31, while the other petition will be listed on February 7, 2011.
Prof. Singh submitted before the court that election of four members of RS from J&K was held in 2009 through three different notifications to “benefit the ruling parties.”
He said that purpose of Article 80 and 83 of Constitution of India stood defeated as the jurisprudence of ‘the single transferable vote’ was demolished by issuing separate notifications of four RS Members whose vacancies were created on the same day and they were elected on the same day for a period of six years.
