Jammu, Dec 6: Jammu and Kashmir High Court, Jammu wing, Monday appointed a Judicial officer, Third Additional Sessions Judge Jammu, as Board of Management Jammu and Kashmir Cooperative Housing Corporation Limited, in place of Deputy Commissioner Jammu and Registrars Cooperative Societies, to run the affairs and hold fresh elections of the Corporation.
In a petition filed by the Board of Directors of the Corporation, who were superseded by DC Jammu vide Govt order No 27-COOP of 2010 dated November 29, following allegations of major financial scam, Justice J P Singh quashed the government order and appointed Third Additional Sessions Judge Jammu Pawan Dev Kotwal as Board of Management.
The petitioner pleaded that the order was bad in law as the statutory notice of 15 days as contemplated in the provisions of section 30 of J&K Cooperative Society Act 19879 had not been issued to the Board before its dissolution.
The court observed that the terms of the Board of Directors was to be expired on December 17, 2010. The process of election initiated by the society may not be completed before the expiry of its term even if government order is set-asidem the court observed adding that and in view of the allegations appearing against the management it was suggested by the counsel for the parties that the Court may, in the interest of the corporation, appoint an independent person to act as the Board of Management, who may run the affairs of the Corporation and initiate election process for the electing the Board of Directors in accordance with law, rules and bye-laws governing the corporation.
