Court asks govt to file objections in 4 weeks

Srinagar, Feb 15: The High Court has directed the government to file objections in four weeks in quashing of detention of Hurriyat Conference (G) leader, Masrat Alam under Public Safety Act. The court also directed the state to consider the shifting of Masrat Alam from Kathua jail to Central Jail here.
Counsel for the petitioner, Mian Abdul Qayoom submitted before the court that in light of the Supreme Court direction 1982, the detainee should be kept in a jail near to the court where his trail was going on.
He said Masrat Alam had been detained under PSA for seventh time since 2008 and had never been released, adding the detaining authority had misused powers and detained him under “malafide grounds.”
He said the District Magistrate Srinagar, who is the detaining authority must pay Rs 50 lakh as compensation to the detainee.
The Court after hearing the submissions from both sides directed the government to file objections in four weeks and also consider the shifting of Masrat Alam from Kathua jail to Srinagar.
