Srinagar, July 9: The High Court today issued notice to the State Government, the Deputy Commissioner Srinagar and the Advocate General of the State on a petition filed against the arrest of the High Court Bar Association president Mian Abdul Qayoom.
The writ petition challenging Bar president’s detention was filed today before the High Court.
Arguing the case, senior Counsel Z A Shah assisted by advocate Manzoor Ahmad Bhat pleaded that the detention was invalid and unconstitutional. The petitioner has sought shifting of the detainee from Sub-Jail Hiranagar Jammu to Central Jail Srinagar as immediate relief.
Shah argued that the detainee has been discharging duties as professional advocate including critical examination of the Government decisions. He argued the allegations leveled against Qayoom don’t involve the violation of any law. The detainee, he said, has his own political beliefs and has every right to propagate them.
The Single Bench of Justice Muhammad Yaqoob Mir after hearing the counsel issued notice to the State Government, the District Magistrate Srinagar and the advocate general of the State.
The Court directed the Superintendent sub-jail Hiranagar to provide requisite medical facilities to the detainee and take him to hospital to get him examined because of his ailing health. The Court directed that family of members of the detainee and the advocate Manzoor Ahmad Dar who has filed petition seeking his release, should be allowed to have meeting with him. The Court has fixed July 14, 2010 as next date of hearing of the case.
The District Magistrate Srinagar didn’t provide the curfew passes to the lawyers who wanted to visit the Court to plead the case. “The High Court had to intervene in the matter,” said advocate Muhmmad Ashraf Bhat.
Bhat said one of the allegation against Qayoom states that he supports stone pelting.
