Multi-Crore FCI carriage contract case
DB orders release of deposited amount
Jammu, June 1: A Division Bench of Jammu and Kashmir High Court today directed its Registry to release the amount deposited before it in favour of the Food Corporation of India.
The directions were passed by the Bench, comprising Chief Justice Dr Aftab H Saikia and Justice JP Singh, in two applications seeking modification of order dated May 10 in the much publicized multi-crore carriage contract of Food Corporation of India case.
After hearing the counsels, the court observed that it was inclined to modified the interim order where by FCI was directed to deposit 50 per cent of the security amount, deposited with it as security by the carriage contractors, with the Registry of the HC.
The court while disposing off the CMP directed that the deposited amount shall be released in favour of the FCI and the contract allotted to the private respondents shall remain subject to the outcome of the LPA.
It is pertinent to mention here that M/S Shivam Enterprises has filed an appeal before the Division Bench seeking setting-aside the judgment of Single Judge whereby the Single Judge dismissed the petition.
