Srinagar, Mar 22: The Court of 3rd Additional Sessions Judge issued notice to the Superintendent Central Jail Srinagar directing him to appear in person before the Court for trying to bring a political detainee Nayeem Ahmad Khan handcuffed to the Court.
The Court has directed the SP jail to ensure the guidelines laid down by the Apex Court for the political prisoners.
On the previous hearing Khan had refused to visit the court handcuffed. But the situation didn’t change during the next hearing of the case on Saturday March 20, 2010. His counsel Rafiq Joo said Khan was again not produced before the Court on March 20. This time also he was handcuffed which forced him not to board the vehicle, he said.
 Counsel filed the application before the 3rd Additional Sessions Judge seeking appropriate directions to the SP jail to produce Nayeem in the Court without handcuffs.
 The application said that producing the detainee before the Court in handcuffs was in total violation of the Supreme Court directions. “Since the alleged accused is a political activist and is not involved in any criminal activities therefore there was no need to produce the alleged accused before the Court handcuffed,” the petition said.
 The application by the counsel said; “On Saturday March 20, the detainee was to be produced before the Court but he was not produced as he refused to wear the handcuffs. This is clear violation of the SC guidelines.”
 The application stated that the SP jail has committed contempt of the Court by not following the SC directions. The counsel had sought directions to the SP jail to produce Nayeem Ahmad Khan before the Court without handcuffs.
 In its order issued by the 3rd Additional District and Sessions Judge said that notice be issued to the SP central jail Srinagar for personal appearance in the court.  The Court directed the SP jail come up with the statement facts as well.
