Shabir Shah, Masarat Alam PSA: Court reserves judgment

Srinagar, Mar 23: The High Court today reserved the judgment in the detention under Public Safety Act of chairmen Democratic Freedom Party and JK Muslim League, Shabir Ahmad Shah and Masarat Alam Butt.
On February 2 the Police arrested Shah from his Sanatnagar residence and subsequently, the District Magistrate Srinagar on February 9 slapped PSA (DMS/PSA/73/2009) on Shah who was shifted to Kathua Jail.
A writ petition has been filed by Shah’s wife, Dr Bilquees through her counsel Mian Abdul Qayoom in quashing the detention and shifting of the detainee from Kathua to Srinagar Jail.
Qayoom submitted before the court that the detention grounds were same as in earlier PSA against his client, adding that Shah could not be detained under PSA again on same grounds.
Terming them as ‘vague’, Qayoom said, “Order of detention is dated February 9 while it has been signed on January 9. This is clear non-application of mind from part of detaining authority.”
Qayoom said the detaining authority had mentioned that his client had instigated people for disturbing peace. However, they have not mentioned the people, whom he instigated. Qayoom also sought Rs 50 lakh as compensation from the authority for repeatedly slapping PSAs on his client.
After hearing the submission from both the sides’ court reserved the judgment.
Meanwhile, in case of Masarat’s hearing, Qayoom said Masarat was booked under PSA on February 2– seventh time in a row – and as per the current detention orders passed by District Magistrate Srinagar, Me’raj Kakroo, Masarat has been ordered to be lodged at District Jail Kathua.
Terming the grounds of detention ‘frivolous’, he said, “Order of detention is dated February 3 while as it has been signed on February 2. This is clear non-application of mind from part of detaining authority.”
After hearing both sides, the High Court reserved the judgment in the detention order.
