Court seeks details from prosecution

Srinagar, May 1: A local court on Saturday asked the prosecution to present its arguments on May 8 in Wamiq Farooq’ case, who died after being hit by a police shell on January 31 in old city here.
In response to the complaint filed on March 27 by Wamiq’s father seeking murder charges against the accused, the Chief Judicial Magistrate, Muhammad Ibrahim Wani said the Court had already recorded the statement of three witnesses and would hear the arguments on May 8.
“Court is yet to hear the prosecution. We have to give equal opportunities to both the sides,” the CJM said.
Wamiq’s father, Farooq Ahmad Wani had prayed before the court that it should pass directions to police to register an FIR under 302 RPC against Assistant Sub-Inspector Abdul Khaliq and the Constable Muhammad Akram, who according to the petitioner had fired the tear smoke canister towards Wamiq.
However, the police on February 20, in its report described teenager Wamiq as a “miscreant” who according to it was involved in stone throwing and succumbed to an injury sustained in police’s “retaliatory measure” at Rajouri Kadal.
In their application, the family has said that Wamiq was playing carom when a tear smoke canister hit his head. The family had also sought constitution of a Special Investigation Team to investigate the killing.
On April 16, the court heard and recorded the statements of two witnesses produced by the family. Reportedly, both the witnesses have deposed that on January 1 no protests took place in Rajouri Kadal area where Wamiq was playing carom.
