HC reserves judgement
Qayoom, Shaheen case
SAMAAN LATEEF
Srinagar, Sept 4: The High Court Saturday reserved for judgement in the detention cases of the Bar Association president Mian Abdul Qayoom and general secretary G N Shaheen.
In Qayoom’s case, the Court issued notice to the Commissioner Home Department, B R Sharma in a contempt petition filed today by the Bar Association against the government for not complying with the July 20 court order in which it had been asked to reconsider the lodgement of the detainee.
The court had termed the lodgement of Qayoom in Heeranagar jail unjustified and asked the state government to reconsider it.
The main detention case of the two Bar members came before the court of Justice Muzaffar Hussain Attar for final arguments. After hearing the arguments from both sides, the court reserved the judgements in both the cases.
In the case of Mian Qayoom, Zaffar Ahmad Shah appeared before the court and submitted that the detainee was not given opportunity to make effective representation before the detaining authority, District Magistrate, immediately on his arrest.
Contending the arguments of Zaffar Shah, the state government through advocate general Isaaq Qadri submitted that the order of detention was according to laws.
Court after hearing the parties have reserved the judgement.
In case of Shaheen, Z A Qureshi appeared before the court. He also argued the case of his client on same lines as in Mian Qayoom’s. After hearing the argument court reserved the judgement.
