Court quashes Qazi Yasir’s PSA

Srinagar, Apr 22: Terming the detention under Public Safety Act of Mirwaiz south Kashmir, Qazi Yasir as “illegal”, the High Court Friday quashed his detention and directed the state government to release him.
Court of Justice Muhammad Yaqoob Mir observed that the grounds mentioned in the detention order were not sufficient to detain Yasir under PSA.
Justice Mir, termed the detention “illegal and unconstitutional” and quashed it, Yasir’s counsel advocate Nazir Ahmad Ronga told Greater Kashmir.
Pertinently, Qazi Yasir was booked under PSA in 2010 on different charges.
One of the charges leveled against him in the dossier issued by the District Magistrate reads: “You held a meeting in Jamia Masjid Hanfia where among other things you threatened shopkeepers to replace word Anantnag with Islamabad on their sign boards and that too be written with green colour, which clearly indicates that you want to disturb the communal harmony in the district.”
Yasir has also been charged for raising “anti-national” slogans including ‘Ragda Ragda….’
The other charges included organizing campaigns on regular basis in Islamabad (Anantnag) district aimed at motivating the people to hold anti-government demonstrations and instigating people of the town to pelt stones on the police and paramilitary CRPF men, government offices and public property. “The participants of the processions under your command injured several police and security personnel and damaged public property,” reads the dossier. It further adds, “On the death anniversary of late Qazi Nisar you led processions at Dialgam village and pelted stones on shops to enforce shutdown there.”
Leading the violent protests after the killing of three teenagers in the town on June 29, 2010 has also been cited as one of the grounds of detention. “On June 29, 2010, you instigated the people of the town who under your directions took out a big procession and indulged in loot and arson. They also set ablaze dozens of vehicles and public property in the town. In this connection police have registered case FIR no.s 261/2010 U/S 148, 149, 332, 336, 307, 427, 435 RPC and 262/2010 U/S 148, 149, 336, 427, 435, 436 RPC,” the dossier said.
He has also been charged of ‘using some hooligans who threaten the public in general and shopkeepers in particular of dire consequences in case they don’t observe hartals in the town.’
Meanwhile, the court also quashed the detention under PSA of human rights activist Ehsaan Untoo and directed state government to release him.
While hearing the submissions of Advocate Ronga in length, court quashed the PSA.
Ronga said, “Court termed the detention under PSA against his client illegal and unconstitutional.”
Court of justice, Mansoor Ahmad Mir also quashed the detention under PSA of Zakir Maqbool, a student of Islamia College Srinagar, and directed state government to his release him.
