HC issues notices to respondents
DISQUALIFICATION CASE OF BJP MLAS

Srinagar, Dec 12: The High Court on Monday issued notice to Advocate General to appear on behalf of official respondents in the case of disqualification of six BJP legislators. The court also directed two BJP legislators to file response in the petition filed by the six ‘disqualified’ MLAs of the party who seek stay on their disqualification order.
The court of Justice Muhammad Yaqoob Mir asked Advocate General for appearing on behalf of commissioner secretary law and parliamentary affairs, Jammu and Kashmir Legislative Assembly through its Speaker, Speaker J & K Legislative Assembly, Chairman Legislative Council.
The court also served notice to two BJP legislators, ChamanLal Gupta and Jugal Kishore who are respondents in the petition to file their response by or before 19 December, the next date of hearing.
Six BJP legislators who were disqualified by their party for alleged cross voting in the April LC polls have filed a petition in the High Court seeking stay on the disqualification order.
Counsel for the disqualified MLAs, JavidIqbal pleaded before the court that till the final disposal of the main petition, the impugned disqualification order passed on November 17, 2011 be stayed.
The counsel also argued that commissioner secretary law, Jammu and Kashmir Legislative Assembly through its Speaker, Speaker J & K Legislative Assembly, Chairman Legislative Council to refrain from acting upon the disqualification order passed against the petitioners.
The disqualification order was passed against the petitioners in disqualification motion no I of 2011titled Ashok Khajuria versus ChamanLal Gupta and others passed by MLA Nagrota ,Jugal Kishore.
