Tax evasion: High Court treats writ as PIL

Jammu, July 17: Jammu and Kashmir High Court has treated a writ petition, seeking direction to the state for recovery of more than Rs 1000 crore tax from the defaulters across the state, as Public Interest Litigation.
 A petition has been filed by Balvinder Singh seeking direction to the Commissioner/Secretary Sales Tax, Commissioner Commercial Tax J&K, Deputy Commissioner Commercial Tax Recovery Srinagar, Deputy Commissioner Commercial Tax Recovery Jammu, SSP Srinagar and Jammu to recover the amount of Sales Tax and Vat from all the defaulters. The petitioner claimed that no action had been taken against the defaulters and an amount of more than Rs 1000 crore remained unrealized.
 Justice Virender Singh, observed that the instant petition espouses public interest at large as huge public money sought to be recovered was involved as such deserves to be heard by an appropriate bench. The court directed the Registry to put the petition before the appropriate bench in the next week only subject to availability of bench.
 An RTI query has revealed that just in the last 10 years around Rs 1000 crore of taxes have been evaded. Many defaulters are the rich and the powerful. (JNF)
