Apex court refers JKNPP petition to Constitution Bench

New Delhi, July 4: A Division Bench of the Supreme Court on Monday referred the petition filed by J&K National Panthers Party (JKNPP) challenging the constitutionality of the permit for return of the militants from Pakistan administered Kashmir (PaK) and their rehabilitation in Jammu and Kashmir to Constitution Bench, a spokesman of the JKNPP said
He said, after hearing Prof Bhim Singh, advocate, the Division Bench comprising Justice Altmas Kabir and Justice Cyriac Joseph referred the petition to the Constitution Bench observing, "As the main petition against Resettlement Act, 1982 is seized in the Constitution Bench of the Supreme Court which was constituted to hear the petition filed by the Panthers Party."
The petition, the spokesman said, has challenged the decision of the Govt of J&K supported by the Union Home Ministry which provides that the militants who crossed over to PaK between 1989 and 1990 to seek arms training shall be brought back to JK by issuing permits by the Union Home Ministry. About 1300 militants have been recommended by the JK Government to return to Kashmir.
“The petition has described this Act of J&K government backed by the Union Home Ministry as the threat to the security of the country which may disturb communal harmony,” he added.
