Court frames Robkar against top officials

Srinagar, Mar 30: The High Court on Tuesday framed Robkar against the Commissioner Secretary and Director School Education for “deliberately” flouting the court orders.
 The court of Justice Mansoor Ahmad Mir framed Robkar against Commissioner Secretary Naseema Lankar, Director Shagufta Parveen of School Education Department and principal Government Higher Secondary School Wagoora Baramulla over their silence in implementing the court order in a promotion case.
 Justice Mansoor observed that officials had not bothered to come before the court to seek extension of time for clearing the administrative wrangles in the promotion of Bashir Ahmad Kirmani from Librarian to Chief Librarian in HSS Wagoora.
 On May 26, 2010 court disposed off the petition of Kirmani seeking promotion from Librarian to Chief Librarian’s post. The court had directed the officials to consider the claim of the petitioner for grant of benefits.  It had also directed the officials to implement the orders within 3-months. However, officials did not compile with the court directions within timeframe constraining the petitioner to file a contempt petition.
 Government through its counsels contended the contempt petition and said the case was submitted to General Administrative Department (GAD) for orders in February, 2011.
 They filed the communication before the court with the statement of facts. However, communication is dated January 14 while as statement of facts has been filed on February 8, the court said.
 Taking into account the date of filing of statement of facts, court said, “The officials had not bothered to come before the court to seek extension of time for clearing administrative wrangles in the case.”
 “The silence maintained by the officials in the matter from February 8 till date suggests that they have flouted the court orders with impunity,” the court observed.
 Consequently, Robkar was framed against the “erring” officials and listed the contempt petition for hearing after 2-weeks.
