Court rejects Asiya’s plea for medicare in Sgr

Srinagar, Mar 3: The Chief Judicial Magistrate on Thursday rejected the plea of Dukhtaran-e-Milat chief, Asiya Andrabi, who is presently lodged in Kot Bhalwal Jammu under Public Safety Act, of providing her medical facilities here.
Asiya had filed an application before CJM, Yashpal Bourney seeking medical facilities in Srinagar after the jail authorities in Jammu allegedly refused to take her to the hospital fearing attack on her from ‘miscreants’.
Asiya along with other party activists is facing charges of attacking a Cyber Café in 2007. The Cyber Cafés across the city were attacked by the Dukhtaran activist for alleged involvement in propagating social evils.
While rejecting the submissions of Asiya’s counsels, Mir Shafaqat Hussain and Bashir Siddique, CJM said, “Asiya should be provided first-aid in Srinagar and sent back to Kot Bhalwal.”
Earlier, her counsels argued that first-aid is provided to minor injuries. They said their client was suffering from serious ailments and should be provided adequate medical facilities.
They submitted before the court that Jail authorities in Jammu had allegedly failed to provide her adequate medical facilities because of the apprehensions of attack on her by “miscreants.”
Shafaqat said, “We submitted an application in the court seeking her temporary detention at central jail Srinagar till her health improves. But the court turned it down.”
Soon after court directed police to send Asiya back to Kot Bhalwal jail, her two sons, Muhammad Bin Qasim and Ahmad Bin Qasim, accompanied by DeM activists bid adue to her with wet eyes.
Muhammad, Ahmad and DeM activists arrived in the court premises before the police cavalcade carrying Asiya from the jail. As soon as she stepped down, the sons surrounded the mother. The mix of smiles and tears clearly reflected their desperation to be together.
“She has been at Kot Bhalwal for past seven months and we only get to see her occasionally. So today we decided to meet our mother in the court,” Asiya’s teenaged elder son, Muhammad, told Greater Kashmir.
Another accused in ‘moral policing’ is her close aide Fahmeeda Sofi. She was also presented before the court and was sent back to Kot Bhalwal. Sofi’s counsel, Shafaqat Hussain, submitted before the court that Sofi’s PSA was already quashed by the High Court. He contested that she should not be sent back to Jammu jail. However, court rejected the plea and maintained her detention at Kot Bhalwal.
