Second consecutive bail rejected
Srinagar, May 24: A local Court has rejected the second bail application of a rape accused.
The Chief Judicial Magistrate, Yashpal Bourney rejected the bail application of Hilal Ahmad Machloo of Hamdaniya Colony of Bemina, for the second consecutive time on the grounds that there was no change in circumstances since the last bail was rejected.
Previously the CJM had rejected the bail application of Machloo two weeks ago on the grounds that the victims would feel traumatized and disrespected and granting of bail would send a bad message in the society.
This time the court observed that the application is ‘presented as the replica of previous bail application so there is no ground for granting the bail to the accused’.
In the second application the counsel for the accused had attached copies of affidavits of two senior citizens to support the bail plea. However, the court considered it ‘falsely implicated’ and rejected it.
“Court has enough material including the victims’ statements under Section 164 of CrPc to take forward the case for hearing,” the CJM said.
Bashir Siddique, counsel for the victim, said: “It is a crime against the society and the accused would cause harm to the victims or their parents”.
The Incident took place on the evening of May 2 in the Hamdaniya Colony Bemina here when the victims, who study in class 4th and Class 2nd respectively, had gone to take tuitions from Hilal’s sister.
