Srinagar, Oct 24: Syed Talib Hussain, son of National Conference worker Syed Muhammad Yousuf who died in mysterious circumstances on September 30, has filed a complaint in the court of Special Judge Anti-Corruption seeking direction for registration of a case by Central Bureau of Investigation (CBI) against Chief Minister Omar Abdullah, National Conference president and Union Minister Farooq Abdullah, Minister of State for Home Nasir Aslam Wani, IG Crime Branch Raja Ajaz Ali, SSP Crime Branch Srinagar Abdul Gaffar Malik, former PSO to Chief Minister Shabir Ahmad, Deputy Superintendent of Police Nasir Khan and Assistant Sub-Inspector SP Singh.
The Court partially heard the arguments on the application on Saturday, counsel for the complainant, Mushtaq Ahmad Dar said.
“It is prayed that a direction be given to Director CBI, DIG CBI and Superintendent of Police CBI to register a case against the accused and thoroughly investigate the matter in due course of law and bring the accused who are involved in the offences for receiving of cash for MLC and ministerial berths and killing of my father be brought to justice,” reads the complaint.
“Or any other order or direction which is warranted under the circumstances of the case be also passed so as to make the law and rule of law shine for all times to come,” the application said.
In the complaint, the complainant has alleged that after his father (Haji Yousuf) was taken into custody on the orders of respondent no. 1, Chief Minister Omar Abdullah, who ordered respondent no. 2 (Nasir Aslam Wani) to take the father of the applicant to a separate room where the respondents 4,5,6,7 and 8 were present.
“The CCTV footage shown on various channels depicted nothing but a hale and hearty Haji Syed Muhammad Yousuf entering the residence of respondent no. 1 and after leaving the residence he was shown broken, unable to walk and virtually supported by three security men to support him in walking and his shirt was out of his pants while the footage of entrance shows his shirt in the pants with belts on,” said the complainant.
The complainant has alleged that his father was mercilessly beaten to pulp especially in the abdomen as he had complained about abdominal pain which showed that he was given kicks and blows and he had vomited blood in the vehicle in which he was finally thrown and taken to Crime Branch headquarters Srinagar.
“Instead of taking him to the hospital he (Haji Yousuf) was taken to Crime Branch Srinagar and allegedly taken to PCR Srinagar and hospitalized but the testimony given by Abdul Salam Reshi, the star and ocular witness in the case on various channels especially Times Now, reveals that he vomited blood which was taken by the driver of the vehicle in some bucket/cane in the vehicle in which he was taken to Crime Branch Srinagar,” the complaint said.
As per the complaint, on September 30, 2011, at about 1:30 pm, the witness Abdul Salam Reshi who also was brought to Crime Branch Srinagar in the said vehicle narrated an important fact to the relatives of the deceased and his friends that Yousuf’s condition was critical when he came out of the house of respondent no. 1 (Chief Minister).
“He (Haji Yousuf) was taken out from the residence of the respondent no. 1 at 6:13 pm  on 29 September 2011 in most critical condition and the respondents would have hushed up the matter by throwing the body on the roadside but the important witnesses whose number is more than the accused suggest nothing but a conspiracy hatched to do away with the life of the father of the applicant as the father of the applicant had said that he would make revelations which would create havoc in political circles and would expose the corrupt practices of the respondents,” the complaint reveals.
“The deceased had asked the respondent no. 1 to wait till respondent no. 3 (Dr. Farooq Abdullah) comes back from outside the country but the respondents 1 and 2 did not wait and virtually have ordered and arranged the gruesome murder of the father of the applicant through their subordinates and other respondents,” says the compliant.
61-year-old Haji Yousuf died in mysterious circumstances after being handed over to Crime Branch of the state police at Chief Minister Omar Abdullah’s official residence on September 29 following a complaint by two NC activists - Muhammad Yousuf Bhat of Ganderbal and Abdul Salam Reshi of Kokernag, that he (Haji Yousuf) had taken Rs 1.18 crore from them for “ensuring a ministerial berth and a berth in the Legislative Council for them.”
Pertinently, Chief Minister has ordered a judicial inquiry by a sitting Judge of the High Court and he has said that all facts will be placed before the people.
