Court directs State to relocate 3 foreign under-trials
Counsel seeks lodging of accused at lock-ups nearer to their trial court

Srinagar, Dec 12: A local court Wednesday directed the State to lodge two foreign ‘militants’ at Central Jail Srinagar and district jail Baramulla while sending the third ‘militant’ back to district jail Udhampur.
Additional District and Sessions Judge Srinagar R K Wattal directed the government to lodge Wasim Noor at Central Jail Srinagar and Fakhurul Zaman Khokar at district jail Baramulla after the accused foreigners were produced before the court. The Court however directed to lodge another foreigner Muhammad Mekayal at district jail Udhampur as the High Court has already quashed his detention order.
The court had earlier directed the Director General of Police to ensure presence of three accused before it on December 12 for hearing and had said that in case of any failure it would refer the case to High Court for necessary action.
Counsel for the accused Advocate Mir Shafaqat Hussain had earlier argued that despite court directions to lodge the accused at the lock-up nearer to their trial court, they were lodged in the jails at far-off places which make their presence in the court on the date of trial difficult. He had pleaded that the accused have not been produced before the court for the past six months. “This has protracted their trial in violation of law,” he had argued.
After hearing the Counsel, the court had disapproved of the “indifference” shown by the concerned officer in the matter and had directed the DGP to ensure the presence of the three under-trials before it.
Muhammad Mekayal and Waseem Noor are undergoing trial in FIR no 231 of 2009 of Saddar Police Station while Fakhrul Zaman is facing the trial in FIR no 93/2011 of Police station Ragbagh.
