Reserved category engineers get fast track promotions

Srinagar, Dec 29: The J&K Public Health Engineering Department is facing strong criticism from general-category engineers for failing to promote them while facilitating fast track promotions of the engineers from reserved categories, Greater Kashmir has learnt.
Sources said there was an “unprecedented unrest” among engineers of the department owing to “denial” of promotions to “deserving” general-category engineers. “The presence of reserved-category engineers at higher posts of Executive Engineers and Superintending Engineers has exceeded the prescribed limit of 31 percent and has crossed 50 percent mark,” they said.
Sources said in case of diploma holders’ quota of Executive Engineers (XN), there was 100 percent presence of reserved categories against all civil service rules as well as against the reservation rules. “And what does this all lead to in the department is bargain. Instead of devoting time to their legitimate duties, engineers have been forced to file a number of petitions before the High Court,” they said.
In one of the cases, sources said, Government has admitted that against 82 duty posts of Executive Engineers, there were presently 57 engineers from reserved categories in the cadre which is 70 percent of the total strength. Pertinently, the High Court has stayed the promotions of engineers from reserved categories to the posts of Executive Engineers, Superintending Engineers and Chief Engineers.
“The promotional mess is such that Assistant Executive Engineers with decades of Gazetted Service are being surpassed for promotion to Executive Engineers by junior engineers with much lesser experience and service,” the sources said, adding, “Such treatment with general category engineers is a mere discrimination.”
The general-category engineers, according to sources, had even made a representation to Chief Minister Omar Abdullah, seeking “justice” in view of “facts on ground” and the April 27 Judgment of the Supreme Court which held “reservation in promotion and consequential seniority as ultra-virus to constitution till fulfilment of certain preconditions.”
“The CM then referred the matter to Chief Secretary but no action was taken on the matter,” sources said.
As revealed through an RTI application, the department had put the number of vacancies for promotion to the posts of XN as 39 as on 12-12-2012 but has promoted only 18 AEEs vide Government Order No. PW (Hyd) - 539 of 24-12-2012 keeping posts “reserved” for reserved categories.
“Following similar court directions, the R&B department under the direct control of the CM made promotions to the post of Executive Engineer recently without any such undue reservation. But in stark contrast the Minister for PHE/I&FC is adamant on such undue reservation and the PHE/I&FC Department has flouted all norms and Court directions,” the sources said.
Sources said the J&K State Power Development Corporation has been requesting the PHE/I&FC Department to depute engineers for execution of power projects under J&K State Power Development Corporation and Chenab Valley Power Corporation but the Department has shown “no interest” on the issue. “The execution of projects, which could boost the economy of the state, has got stalled only because of the department’s adamant approach,” source said.
They said engineers of the department have sought that PHE department be brought under the “scrutiny” of State Vigilance Organization and the State Accountability Commission to ascertain the reasons for “bestowing undue favour” to the reserved-category engineers “at the cost” of general-category engineers.
