Practice, pursuing LLM can’t go together: HC

Srinagar, Feb 11: Observing that a candidate’s practice at Bar was in sync with her LLM course period, the High Court has dismissed the petition filed by a candidate seeking direction to the Public Service Commission for considering her application for the post of Assistant Legal Remembrance.
Justice Mansoor Ahmad Mir while passing order on the petition observed that the candidate could not produce a required practice certificate of three years as she was simultaneously pursuing LLM course at University of Kashmir
Senior Additional Advocate General, A M Magray representing the respondents informed the court that the candidate had concealed the fact that she was pursuing LLM at the time when she applied for the practice license, otherwise she would not have got the license.
“The petitioner was supposed to intimate the competent authority about pursuing LLM course and license to the practice law was to be suspended till she would have resumed practice” the court ruled, observing the petitioner had concealed facts and her conduct goes in breach of Bar Council of India Rules.
The Court observed that the petitioner had admitted that she got admission in LLM in June 2005 and appeared in last semester in August, 2007 and the license to practice law was granted to her on November 13, 2006, when she was already enrolled for LLM.
The court ruled that it was mandatory for the candidate to inform the Authority issuing license about her LLM course.
The state Public Service Commission had rejected the application of Shaista Amin on the grounds that she was deficient in practice of three years required for the posts of Assistant legal Remembrance for which the PSC had issued advertisement notice on September 24, 2010.
