Complete investigations in 2 months: HC to SIT

Srinagar, Feb 3: The High Court on Friday asked the Special Investigation Team (SIT) probing Tufail Matoo case to complete the investigation within two months besides directing it to file the status report of the probe in four weeks.
Court of Justice Hasnain Massodi passed the direction after hearing arguments of the counsel for the petitioner, Mian Abdul Qayoom and senior Additional Advocate General, A M Magray, representing the state.
The investigating officer, SP City North Showkat Hussain appeared before the court and submitted the status report which was perused by the Court.
Counsel for the petitioner pleaded that SIT is acting in a “dilatory way” in the probe and is repeating the history of the SIT that was constituted earlier by the trial court.
“The SIT constituted under the directions of High Court is working like the SIT that was constituted by the trial court to probe the matter and the investigation stands nowhere,” the counsel argued.
The High Court in its previous hearing had directed the Special Investigation Team (SIT) probing Tufail Matoo case to reach a conclusion within one month.
The counsel submitted that the SIT constituted after the High Court directions requires to carry out the investigation in a prompt manner to ensure justice to the victim family.
On September 26, 2011, the HC had directed the Director General of Police to constitute a SIT headed by a police officer not below the rank of SP to investigate the case.
Family of Tufail Matoo had filed a complaint in the court of Chief Judicial Magistrate Srinagar which had constituted SIT to investigate the matter. However, the family moved the High Court seeking directions for the reconstitution of the SIT.
The High Court later asked the DGP to constitute a new SIT under an SP to investigate the death of the Tufail Matto after counsel for the petitioner had pleaded before the court that the investigation carried out by the earlier SIT was not satisfactory.
Tufail, according to hi family was returning home from tuitions on June 11 in 2010 when police teargas shell hit him near Gani Memorial College in old city, killing him on the spot.
