Charas peddler gets 10-Yrs RI

Srinagar, June 30: The Principal Sessions Court Srinagar on Saturday convicted a Charas peddler and sentenced him to ten years rigorous imprisonment. The court also imposed a fine of Rs two lakh on the convict.
Principal Sessions Judge Srinagar, Kaneez Fatima convicted Muhammad Ramzan Dar of Handwara under section 8/20 NDPS. Dar was chrgesheeted in the court after police filed an FIR against him following the recovery of 3.5 Kilogram Charas from his procession.
The Public Prosecutor, A A Teli defending the state argued before the court that the accused was culpable of committing a heinous crime and deserved a punishment under NDPS Act. The accused was defended by his counsel, Ram Singh.
An FIR 125 of 2009 was registered with Police Station Parimpora against Dar after police recovered Charas from his possession. Police filed chargesheet in the Principal Sessions court Srinagar where prosecution produced eight witnesses in support of its contention of charges against the accused.
The court framed charges against the accused following which statements of the witnesses produced by the prosecution were recorded. The Court recorded statement of the accused under section 342 of RPC after the statements of witnesses from prosecution were recorded.
The accused could not produce any witness after he was directed by the court to lead defence evidence in support of his contention.
The Court after hearing the arguments of the public prosecutor and the counsel representing the accused, sentenced Dar to ten years rigorous imprisonment and imposed a fine of rupees two lakh on him. In case of default to pay the fine, the convict would have to undergo a further imprisonment of two years.
