High Court stays posting of Director Horticulture

Jammu, July 25: Jammu and Kashmir High Court has stayed the posting of Muhammad Saleem Shishgar as Director Horticulture Kashmir.
The directions were issued in a petition filed by Sonam Narboo, Joint Director Horticulture Jammu, challenging the transfer and posting of Shishgar as Director Horticulture Kashmir on various grounds.
Justice JP Singh observed that the counsel for the petitioner has referred to Schedule-II J&K (Gazetted) Service Recruitment Rules 2002 to urge that transfer and posting of the respondent as Director Horticulture Kashmir was in violation of rules as he neither was a member of the feeding service nor did he possess requisite qualification for appointment against the post of Director.
“Prima-facie there appears merit in the submission of the counsel for the petitioner. A case for consideration of petition is made out,” the court held adding, “Issue notice to the respondents for their response within one week and meanwhile operation of Government order No. 723-GAD of 2012 dated July 7, 2012, in so far as it pertains to the transfer and posting of Muhammad Saleem Shishgar as Director Horticulture Kashmir is stayed till next date.”
