This is in response to the write-up “Reservation for whom and for how long” by Dr. Rumana Makhdoomi, raising a genuine concern.  The central legislation of OBC reservation was purely meant to address the grievances of “Non-Hindu” socially & economically backward classes (castes & communities) facing discrimination under the religious based Schedule caste reservation laws in the country. However the rationale behind this legislation of OBC reservation was misused in our state by the politicians & bureaucrats through modifications & amendments to the central OBC commission guidelines/legislations. The very Article 370 meant for safeguarding the interests of the state citizens was manipulated & exploited to carry out the necessary amendments to the central OBC legislation such as to suit their nefarious designs. As per the central OBC Legislation/commission about 21 socially & economically backward castes/ communities are recognized as OBC’s  from the state of J&K and who are only entitled for a 27% reservation at present under Resolution No 12011/7/95-BCC dt. 24/05/95 published in the Gazette of India Extraordinary Part I Section I No. 88 dated 25/05/95. However the state Govt. under the garb of Article 370 invented a state of the art OBC format under SRO 294 OF 2005, including in it the new inventions of RBA & ALC.  Unfortunately the reservation rights of 27% meant for people belonging to those castes & communities as identified in the central list OBC’s, were instead embezzled & showered upon certain people on the basis of their place of residence (RBA & ALC) rather than considering caste & community status. Consequently a well-designed result-oriented legislation brought after hectic deliberations and meant for the social, economic & political uplift of backward classes of the society was murdered by the state politicians. It is unfortunate that while Xerox copies of oppressive & suppressive central laws & legislations are enacted by Kashmir assembly, those pertaining to welfare of downtrodden sections of society are sacrificed & compromised for their own petty interests. Doesn’t it tantamount to “legislative facilitation for reservation misappropriation”.
