Srinagar, Nov 10: Jammu and Kashmir High Court has directed principal district judge Srinagar to inquire into the disappearance of a man who was allegedly picked by Army from his residence at Dalgate in 2000 and file the report within three months.
A bench of justice Hasnain Massodi passed the direction on a petition seeking judicial probe into the circumstances leading to disappearance of a youth Firdous Ahmad Bawan who was allegedly arrested by Army from his residence at Buchwara Dalgate on September 25, 2000.
Court asked the parties in the case to appear before the Principal district Judge on November, 15.
Counsel for the victim family, Mir Shafaqat Hussain informed court that the state Human Rights Commission has passed a Judgment holding it that the detainee disappeared from the custody of the Army.
An FIR under criminal section of disappearance of RPC was registered in Ram Munshi Bagh Police Station by the police after family of Bawan brought the matter to its notice that men in uniform picked him from his residence.
Police subsequently carried out investigation and filed the report as untraced in the competent court.
The family filed a petition in the High Court seeking judicial probe into the matter as also Rs 75 lakh as compensation for the legal heirs of Bawan.
It also sought directions to register a criminal case against the army personnel responsible for the arrest of the accused.
