OUTSTANDING SPORTS CAREER ISSUE

Srinagar, Nov 13: Ruling that participation of a candidate in Ist Senior National 20- Cricket Champion does not make him deserve ‘Outstanding sports career certificate’, Jammu and Kashmir High Court has set aside a single bench judgment wherein Services Selection Board was directed to consider the certificate for his appointment as Physical Education teacher.
Setting aside the single bench judgment, a division bench of High Court held that the 10 points awarded to the candidate for his participation in 1st Senior National 20- Cricket Champion cannot be considered for his selection as Physical Education Teacher for district Pulwama.
The state had filed an appeal against the writ court decision after the court had pronounced decision in favor of Javid Ahmad who had participated in the event.
The court said ‘it has to be seen what participation of the candidate in the 1st Senior National 20- Cricket Champion constitutes outstanding sports career at national and international level mean’.
While referring to Jammu and Kashmir (Appointment of Outstanding Sports Persons) Rules, 1998, the court held a person can be granted this certificate if he has represented India at the Olympic Games/ SAARC games/ Common Wealth Games/ Asian Games or other officially recognized test matches and World cup competitions in any of the games of sports.
“A person who has won first, second or third position in the individual or team events in national or All India interstate Competition ( senior level official recognized in any of the games or sports can be said to have Outstanding Sports Career”, the court said.
Additional Advocate General Javid Ahmad Kawoosa represented the state in the case.
