HC quashes detention order of Mushtaq-ul-Islam

Srinagar, Nov 17: Jammu and Kashmir High Court has quashed detention order of chairman Muslim League Mushtaq-ul-Islam directing the government to release him immediately if he is not involved in some other offence.
 A bench of Justice Hasnain Massodi quashed the detention order after petitioner’s counsel, Mir Shafaqat Hussain argued that the detention was not in line with the provisions of law, stating its grounds were coinciding with grounds of the detention under which Mushtaq ul Islam was booked earlier.
 The Court however asked the government to file within three weeks reply to the petition with regard to the contention of the petitioner’s claim for compensation for his illegal detention from May 22 to July 10, 2012 by the state. The court said the reply should also explain the discrepancy in the date of arrest of the detainee after he was let off in the wake of revocation of detention order on July 10, 2012.
