HIGH COURT DISMISSES HAJEEJ PETITION

Srinagar, Nov 5: Jammu and Kashmir High Court Monday dismissed as withdrawn the petition of Fabian Wahid of Hajeej India Hospitality Pvt Ltd seeking quashment of trial court order directing to arrest the accused and producing him before the court in Hajeej India Fraud case.
 The bench of Justice Hasnain Massodi dismissed the petition of Fabian as withdrawn after his counsel submitted that the petitioner wanted to withdraw the petition against the trial Court order of October 5, 2012.
 On the day, the Principal Sessions Court Srinagar had directed that Fabian be arrested and produced before it on October 16, 2012.    
 However the accused subsequently approached the High Court for staying the operation of the trial Court order. The High Court had stayed the order passed by the Principal Session’s Court.
 On Monday Fabian was present in the Court and his counsel did not press for his plea but chose a submission to withdraw the petition.  Government Advocate Shuja ul Haq Tantray represented the state in the case.
 The Court dismissed the petition as withdrawn which facilitated the chances of the arrest of accused as the trial court order retained its strength.
 According to police Hajeej India Hospitality Pvt Ltd has collected a staggering amount of over Rs 5.50 crores from Haj aspirants.
 “Rupees 2.32 crores from Haj aspirants of 2011 through other three companies and about Rs 4.30 crore from Haj aspirants of 2012 which amounts to nearly Rs 12.12 crore from Hajj aspirants of 2011 and 2012,” a police official said.
