Srinagar, Oct 13: A local court Saturday granted bail to three men accused of offences under sections 452 and 352 of RPC as they had jumped into the well of the Legislative Assembly raising slogans on October 8.
Chief Judicial Magistrate Srinagar, Rajeev Gupta while granting bail to the accused directed to release them against surety of Rs 20000 each.
The accused Manish Kumar Khajuria, Ambedkar Gupta and Advocate Sunny Mahajan were arrested after jumping into the well of the House.
The court, however, imposed certain restrictions on the accused directing them to present themselves before the police when required.
They were asked not to leave the state without the permission of the court and should not try to hamper the investigation or tamper with the evidence.
While allowing the application of the accused seeking bail, the court held that the alleged offences against them are punishable under section 452 and 352 of RPC in which a maximum punishment of seven years term can be awarded.
The court said bail cannot be refused to the accused as the offences do not fall in the restricted zone of section 497 of CrPC.
Chief Prosecuting Officer representing the state argued that the attack on state Assembly is no less than the Parliament attack of 2001 pleading the accused deserved severe punishment and no concession.
He told the court that the accused had created the serious law and order situation jeopardizing the security of Chief Minister, cabinet ministers and the legislators.
Seeking rejection of the application, the CPO argued that the accused do not deserve the bail pleading they should be dealt with an iron hand for the offences they have committed.
Counsel of the accused pleaded before the court that the police has completed the investigation into the case and there is no requirement to keep them in custody.
Following their jumping into the well, the House had moved a contempt motion against the accused trio and they were confined to the custody of the House till October 10, 2012 and afterwards Police Station Shaheed Gunj took them into custody.
The accused were produced before the remand magistrate who sent them to judicial custody for 10 days on October 11.
