Government set to issue formal ordinance; proposal to be discussed in next cabinet meet

Jammu, Feb 2: Jammu and Kashmir government is all set to issue an ordinance to pave way for initiation of work on prestigious Bhatinda-Jammu-Srinagar gas pipeline project and a formal decision in this regard is expected in the cabinet meeting, scheduled for next week.
 Well informed sources in the civil secretariat told Greater Kashmir that the Law Department in consultation with some other departments has drafted the proposed ordinance which has been forwarded to the General Administrative Department. “The GAD has been requested to table the proposed ordinance before the cabinet in its next meeting,” sources said. “Once cleared by the cabinet the proposal will be formally sent to the Governor for issuance of the Ordinance.”
 The approved 740-km-long Bhatinda-Jammu-Srinagar gas pipeline project was scheduled to be completed by July 2014 to draw gas from Gujarat to the State. However, the project hit a major roadblock due to the special status enjoyed by Jammu and Kashmir under Article 370 of Indian Constitution. “The government is already working on to bring necessary amendment in Transfer of Property Act Bill and at the same time bring a new legislation on the pattern of Gujrat Gas and Pipeline Act in the upcoming budget session. However, in view of the urgency involved in the matter an Ordinance will be issued so as to enable the state to start process for transfer of the land to Gujarat State Petronet Limited (GSPL), a subsidiary of Gujarat government, which has been awarded the project by Petroleum and Natural Gas Regulatory Board (PNGRB),” the sources said.
 The issuance of the ordinance was necessitated as the government was facing a legal impediment in transferring the land to a non-state subject entity. “As the Central Act viz. Petroleum and Natural Gas Pipeline (Acquisition of Right of User) Act 1962, provisions of Gujarat Water and Gas Pipeline (ROU) Act 2000 and P&MP Act 1962  were not applicable in the State. Similarly, J&K Land Acquisition Immovability Property Act, 1968, does not provide acquisition Right of User (ROU) to Gujarat State Petronet Limited (GPSL) as such there was a need to bring an amendment in the existing laws,” the sources said.
 The proposed gas pipeline will consist of 328-km-long main gas trunk from Bhatinda to Srinagar passing through Kathua, Samba, Jammu, Udhampur, Ramban, Anantnag, Pulwama and Srinagar. There will be hundreds of sub-lines which will supply gas to the consumers at their houses.
 It was on July 7 last year that the GSPL-led consortium was awarded the Letters of Authorisation (LoA) by the PNGRB for developing the pipeline among two more similar projects.
 As per the agreement the project shall be required to be completed within a period of 36 months from the date of award of the LoA to the consortium.
