HC bans use of polythene, except in healthcare sector

When the bench asked chief executive officer of Pahalgam Development Authority whether polythene was still being used in the tourist resort, he answered in affirmative.

The High Court on Thursday said that there shall be a complete ban on polythene in Jammu and Kashmir, except for its use in healthcare establishments for handling and disposal of biomedical waste till it examines whether the statutes permitting use of polythene to some extent was is in line with its directions.  

A division bench of Justice Muhammad Yaqoob Mir and Justice Ali Muhammad Magrey ordered the ban after it observed that polythene is being used in and around the Pahalgam health resort in Anantnag district.

When the bench asked chief executive officer of Pahalgam Development Authority whether polythene was still being used in the tourist resort, he answered in affirmative.

Moreover, the regional director, State Pollution Control Board also informed the court that in keeping with SRO 45, polythene with certain specifications has been directed to be used in the state. When the court asked him how it can be translated into action on ground, he was without any answer to convince the court. The court said that a copy of the SRO-45 shall be placed on record.  

While the court directed the CEO PDA and the authorities of SPCB to ensure there is no use of polythene in Pahalgam, it said that even there should a ban on use of polythene in entire state, except in healthcare establishments for handling and disposal of biomedical waste as per the (Management and Handling) Rules.

The court said that the order will remain in place till it examines as to whether SRO-45 is in line with its directions.
