The High Court has directed the Central Bureau of Investigation (CBI) as well as the Jammu and Kashmir government to respond to a plea against the CBI court’s order accepting probe report by CBI into the killing of 19 civilians in Surankote area of Jammu region in 1998. 

A bench of Justice Ramalingam Sudhakar issued notice to CBI and the state government after hearing Advocate Parvaiz Imroz who appeared for the victim families. 

The victim families are aggrieved of the CBI court’s order dated 25 August 2017 where by the court has accepted the probe report. The families now seek directions for quashing the CBI court order. They also seek further investigation into the case. 

They plead that the CBI be directed to submit status reports before the High Court until the further investigations are completed and final report submitted before the CBI court. 

“Due to an overriding interest to protect the perpetrators of the crimes, the closure report that has been submitted and wrongly accepted by the CBI court does not contain the result of a proper and thorough investigation,” they plead. 

The families have alleged that during the intervening night of 3/ 4 August in 1998, 19 members comprising six males and 13 females of three families were allegedly killed in the house of Hussain Muhammad Sheikh with “active participation” of then SSP J P Jain Singh, Surankote, Major Gora of 9 Para Rashtriya Rifiles C/O 56 APO, Sevak Singh Additional SP Poonch, SPOs Muhammad Younis alias Tiger, Muhammad Rafiq Gujjar alias Pathan, and Havaldars Maqsood Ahmad and Muhammad Akbar who were posted at Police Station Poonch.
