HC dismisses petition of KCS aspirants as ‘withdrawn’

The High Court on Monday dismissed a plea seeking directions to Jammu and Kashmir Public Service Commission for putting off KCS (Judicial) mains examination scheduled to be held from March 23. 

A bench of Justice Tashi Rabstan dismissed the petition by 153 candidates as “withdrawn” after hearing their counsel, Altaf Mehraj. 

In response to the submission by the petitioners’ counsel that the PSC be directed to consider the representation they have made to it, the court said it was not inclined to pass any order directing the commission to consider the representation. 

Following the submission by the petitioners’ counsel that he may be permitted to withdraw the writ petition with liberty to pursue the representation before the commission, the court took on record Mehraj’s statement with liberty as prayed for. 

The petitioners were seeking directions to PSC to reconsider its decision on deferment of the KCS (Judicial) mains examination scheduled to be held from March 23. 

They were also seeking directions for rescheduling the KCS examinations.

“ Most of the remote places of the valley are still disconnected from the mainland due to closure of various passes resulted due to the heavy snowfall as such many candidates who have been held to have qualified for the mains examination are set to miss the examination” the petitioners pleaded. 

They submitted that in the wake of the suicide attack on the forces on February 14, the rising attacks upon the students including some of the petitioners who had undertaken admission in various coaching institutes outside Kashmir for mains examination had to return home in view of the threat to their life. 

Some of them, the petitioners said had to return to their homes leaving midway the coaching and the preparation for undertaking the mains examination. 

The PSC had issued an advertisement notification- PSC/Exam/2018/39 dated 30/05/2018- in terms of which the applications were invited for filling up the vacant posts of Civil Judge(Junior Division)/Munsiffs in the Law, Justice and Parliamentary Affairs Department.

After taking part in the preliminary screening test, the petitioners were declared successful by the PSC and were accordingly declared to have qualified for the admission to the Jammu and KCS (Judicial) mains examination 2018.
