Cheque bounce case | Court sentences man to 2-yr jail

The Court of Judicial Magistrate (Munsiff) Anantnag, Fayaz Ahmad Qureshi Tuesday convicted a man and sentenced him to two years imprisonment in a cheque bounce case.

After hearing counsels for complainant and the accused, theCourt found Ghulam Muhammad Najar of Nowgam guilty for the commission ofoffence under Negotiable Instrument Act and directed him to pay Rs 20 lakhcompensation to the complainant.

   

The Court said the convict will undergo one year rigorousimprisonment and one year simple imprisonment and pay compensation to thecomplainant of rupees twenty lakh and four thousand; the amount double ofcheques issued by him.

The Court issued a single order on two separate cases filedby complainant GhulamRasool Dar in 2017 against Najar.

The Court observed that because of dishonesty of few, peoplehave lost faith in smooth orderly commercial transactions which has not onlystalled free circulation of money from hand to hand like goods but has alsoadversely affected the economy of the country.

As per the complainant, the accused had transaction with thecomplainant for sale of land and timber. However, the accused didn’t performhis duty after receiving rupees ten lakh and two thousand from the complainant.

The accused later agreed to pay back money to thecomplainant and issued three cheques for debt clearance. All the cheques weredishonored by the bank.

The accused failed to clear the debt again after he wasgiven an opportunity by complainant after serving a legal notice, forcing thelater to file complaint before the court.
