Court convicts man for kidnapping, raping minor in 2016

Srinagar, Mar 16:  A fast-track court here Saturday convicted a man from Bihar for kidnapping and raping a 15-year-old minor at Habba Kadal locality here in 2016.

Renu Dogra Gupta, 2nd Additional Sessions Judge (Fast Track Court pertaining to rape cases) convicted Santosh Kumar Paswan, son of Saider Paswan, resident of Lalpora Bhim Nagar Bihar after coming to the conclusion that prosecution beyond any reasonable doubt succeeded in establishing its case fully by way of reliable and clinching evidence.

   

“No conclusion other than guilt of the accused stands established, as such accused is liable to be convicted for the offence punishable under Sections 363(kidnapping) and 376( rape) of RPC( Ranbir Penal Code),” the court said and convicted Paswan in the case registered under FIR No.32 of 2016 at police Station Kralkhud Srinagar for the commission of offence punishable under Sections 363 and 376 of RPC, which now stands replaced by Indian Penal Code(IPC)

The court will pronounce the sentence at a later date, next week.

The charge-sheet had been initially presented before the Court of Chief Judicial Magistrate Srinagar who vide its order dated 22 October 2016 committed the same to 2nd Additional Sessions Judge Srinagar being designated as Fast Track Court pertaining to rape cases.

On February 4, 2017, the court framed charge against the accused for the Commission of the offence under Sections 363, 376 RPC.

According to prosecution, on 1 September 2016 father of the minor girl as complainant lodged a complaint with the police of Police Station Kralkhud to the effect that in his house a person namely Santosh Kumar Paswan was doing mason work and after completing his work at his home, he often used to visit his house.

He said that since early morning his 15-year-old daughter was missing from home and he was having strong doubts that she had been enticed by the accused Paswan.

After receiving the report, police registered the case under FIR

No 32/2016 under relevant section of law at police Station Kralkhud and started the investigation of the case. During the course of search, the girl and kidnapper were found riding on a motorcycle near Humhama and going in suspicious condition towards Airport.

The prosecution said that subsequently they were apprehended and brought to Police post Humhama. The motorcycle, Air tickets of accused and prosecutrix( minor girl) from Srinagar to Delhi were seized.

According to prosecution, the accused without permission of guardian had taken her from home as such offences under section 361,376 RPC were also established against the accused during investigation and these sections were also added in the case.
