Ist Additional Sessions Judge Jammu MA Chodwdhary today rejected the bail applications of three persons facing charges of narcotic smuggling.

The accused all residents of district Poonch  are allegedly involved in smuggling of heroin.

According to the police case police party of Police Station Nowabad Jammu, , during a special naka near St. Peter School Jammu reveals on  17.09.2016,, checked  two vehicles, including  TATA Sumo bearing Registration No. JK22-7655 and Santro Car, bearing no. JKO1-3740 and recovered /seized 265 grams ' heroin' kept in a green coloured polythene bag and cash of  Rs. 2.10 lac from the TATA sumo,   being boarded by four persons  . Police  further  recovered and seized  253 grams of heroin,  kept in a white polythene  and cash amounting to Rs. 90,000/- from two occupants of  Santro Car.  The accused failed to explain justification/ reason for possessing  such narcotic substances. They were arrested and a case vide  FIR No  130/2016  was registered at Police Station  Nowabad against them for the commission of offences punishable  u/ss 8/21/22 of NDPS                                                     Act.

Court after hearing APP Ajay Singh Manhas observed that  the contraband seized from the possession of the applicants is 265 grams and 253 grams  which is commercial quantity. "In view of the commercial quantity of the seized contraband from the possession of the applicants, rigor of section 37 of NDPS Act is attracted which provides that the court can grant bail to the accused/applicants only on satisfaction that the accused have not committed the offence" it said.   With these observations Court rejected the bail application.
