Collector Land Acquisition to finalise compensation: Financial Commissioner

Jammu, Nov 2: The Finance department has directed that the award regarding the payments of land acquisition or compensation would be finalised by the concerned Collectors Land Acquisition – the Deputy Commissioners or ACRs or ADCs.

Financial Commissioner (Additional Chief Secretary) Finance department Atal Dulloo issued this direction while laying a procedure for payment of land acquisition or compensation bills.

   

The procedure was laid down and directions were issued after the Finance department took serious cognisance of the violation of rules in contravention of the government order No 166-F of 2019 dated 27 February 2019.

The order dealt with the duties and responsibilities of Accounts Officers in the offices of Deputy Commissioners or District Development Commissioners.

“It has come to the notice of the Finance department that Collectors Land Acquisition stationed at district headquarters in some districts are presenting the bills at treasuries on account of land acquisition and compensation and the bills are honoured by the Treasury Officers in violation of rules in contravention of the government order No 166-F of 2019 dated 27 February 2019. The issue has been examined in the Finance department and a procedure is laid down for payment of land acquisition and compensation of bills,” Dulloo said in a circular.

As per the procedure, in the offices of Deputy Commissioners or ADCs or SDMs or ACRs where Accounts Officers have been posted, the award regarding the payments of land compensation will be finalised by the concerned Collectors Land Acquisition – the DCs or ACRs or ADCs, as the case may be.

“The amount of such awards should be drawn by the Accounts Officer (DDO) through PaySys from the concerned treasuries. The balances under MH 8443 should be transferred and maintained in the name of Accounts Officer separately for respective Collector Land Acquisition after its verification from the treasuries,” the circular read.

Collectors Land Acquisition, stationed away from district headquarters and delegated with DDO powers in capacity of their primary designation as Additional DC or ACR or SDM, as the case may be, will continue to exercise their powers as Collector Land Acquisition and draw the awarded amount from the treasuries for further disbursement.

“The Treasury officers should continue to entertain their claims under two DDO codes. In the cases where Collector Land Acquisition were appointed for specific projects and have subsequently been abolished or merged on completion of project, the Revenue department should issue instructions for transfer of funds, of undisbursed compensation, to new Collectors Land Acquisition of the area so that the undisbursed amount is accounted for and paid to legitimate beneficiaries. In the absence of any rightful claimants it should be transferred to the government account,” Dulloo directed.
