Division Bench of State High Court Comprising Justice Alok Aradhe and Justice Sanjeev Kumar today granted bail to two murder convict.
They were convicted with 4 others in the much publicized murder case of contractor Yash Paul Singh who was brutally murdered in broad-day light by seven accused on April 7, 1995.
The Trial Court convicted six accused namely Jagvinder Singh alias Pappi, son of Jagjit Singh of Ward No 11, Kathua, Varinder Kumar, son of Bishan Dass of Nagri, Jasbir Singh alias Jassi, son of Raj Singh of Kathua, Ram Nath Raina alias Natha, son of Girdhari Lal of Kathua, Gurdeep Singh alias Kali, son of Harbhajan Singh of Swan Chak and Ajay Kumar alias Kalu, son of Bal Krishan of Kathua.
An application of seeking suspension of sentence and bail was moved by Jagvinder Singh and Varinder Kumar.
The Division Bench, while quoting several apex court and J&K Double Bench judgments, observed that in view of the proposition of law laid down by the Supreme Court as well as the Division Bench of this Court and taking into account the fact that appellants are in jail for the past about 11 years and there is no likelihood of appeal being heard in near future, as the appeals of years 2004 are being heard, we deem it appropriate to enlarge appellant Nos. 1 and 2 on bail, subject to the following conditions that the appellant/applicant Nos. 1 & 2 shall furnish personal bond in the amount of Rs.50,000/- each with two sureties of like amount each to the satisfaction of Registrar Judicial of this Court. That they shall not leave the State of Jammu and Kashmir without permission of this Court and they shall appear before this Court on each and every date of hearing. JNF
