Notice served to 7 officials for ‘breach’ of service conduct rules

The government on Thursday issued show cause notice to seven officials who were working on a probation period in different departments for “violation” of service conduct rules.

According to an official order, the probationers who wereappointed under Jammu and Kashmir Special Recruitment Rules 2015 notified underSRO-202 of 2015 reportedly participated in frequent protests at public spacesand denounced the terms and conditions of service as contained in the rules andJammu and Kashmir Government Employees (Conduct) Rules, 1971.

   

The order states that in exercise of the powers conferred byRule 21 of the Jammu and Kashmir Civil Service (Classification, Control &Appeal) Rules, 1956 the Appointing Authority, at its discretion, may suspendthe probation of a probationer and that a probationer can be discharged fromservice at any time before the expiry of the prescribed period of probationwithout having recourse to regular inquiry and the provisions of Article 311 ofthe Constitution were per se not applicable to a probationer.

Accordingly, show-cause notice was issued to Muneer Hussain,Junior Engineer JPDCL; Dr Arif Hussain, LDC Durbukh Leh; Sanjeev Singh, MedicalOfficer, PHC Budhal, Rajouri; Dr Shafeen Majeed Koul, Medical Officer, PHCJandrah, Jammu; S Amandeep Singh, Patwari, Office of Deputy Commissioner,Jammu; and Amir Tariq, Junior Assistant GAD.

The probationers have been asked to explain why their periodof probation may not be terminated and they be not immediately discharged fromthe service.

They have been directed to send their replies to the noticeto the office of Deputy Secretary, General Administration Department withinseven days, failing which it shall be presumed that they have nothing to say inthe matter and action as warranted under rules shall be taken without anyfurther notice.
