Secretaries asked to file appeals within 10 days from grant of sanction

The department of law on Thursday directed the administrative secretaries to ensure filing of appeals in court within 10 days from date of grant of sanction.

According to a circular issued by Achal Sethi, secretary law, it has been observed that after putting in an extensive labour in grant of sanctions for filing appeals/LPAs/SLPs, petitions are not being followed by the departments and counsels representing the departments before the courts expeditiously.

   

“This has created a worrying situation for the state. The delay in filing these petitions is viewed very seriously by the courts and more often the cases are dismissed at the condonation of delay stage, which state cannot afford to perpetuate,” the circular reads.

“To overcome such a difficulty, it is enjoined upon all the administrative secretaries and HOD’s to ensure filing of appeals/LPAs/SLPs within a period of 10 days from the date of grant of sanction otherwise matter may be placed before competent authority for appropriate action under rules,” the circular reads.
