2 lawyers arrested for ‘forging High Court bail order’ to manage release of clients from jail

Police have arrested two lawyers for allegedly making a forged bail order of the High Court for the release of their clients from jail.

The police took cognisance of matter after the High Court directed it to investigate and file a criminal case against the people responsible.

   

The accused lawyers Aamir Masood and Musavir Ahmad Mir, as per police, had forged a bail order for the clients whose bail application was rejected by trial and appellant court in Budgam.

The fake bail order had fake stamp and signature and they used it to fool the authorities into believing it as a true order issued by High Court. Their clients were released by the police on production of this fake order.

The matter came to light when Police Station Magam in Budgam wanted to file a charge-sheet before the competent court against the clients of these two lawyers.

As per the provisions of law, the investigating officer of the case was required to submit a copy of bail bonds furnished by sureties of accused, along with charge sheet.

As he went to High Court to get the copy of bail bonds, he came to know no such bail order was issued by the High Court in this case.

On the directions of High Court, the Shaheed Gunj police registered the case vide FIR number 83/2017 and took up the investigation. The accused lawyers were arrested on January 8, 2019. Srinagar trial court granted the police five days remand of accused lawyers on Saturday.

“Both the accused (lawyers) have been arrested and further investigation is going on,” SHO Police Station Shaheed Gunj, Parvaiz Ahmad, confirmed to Greater Kashmir.

BRIEF CASE HISTORY:

Three persons accused of vehicle thefts were arrested by Magam police in 2017. After completion of investigation, the accused were lodged in Srinagar central jail.

The bail application of these three persons was rejected by trial court and subsequently by Sessions Court Budgam.

As per the police, the accused lawyers forged the bail order of High Court which was produced before the Srinagar Central Jail authorities where from the accused were released.
