Srinagar, Nov 9: High Court on Friday directed the state government to deport two Pakistani nationals to their native country.
The bench of Justice Muzaffar Hussain Attar directed the government to take all the necessary steps, in accordance with law, to deport the detainee, Saifullah of Gujrawala to Pakistan.
Justice Attar in his order said: "Period of sentence is already over. Respondents (state through Home Secretary, Government of India through Home Secretary and others) are duty bound to deport the detainee to his native country," the bench had said, adding, "Respondents are directed to take all necessary steps within the period of detention prescribed in the order."
Pertinently, the bench of Jammu and Kashmir High Court in June this year had directed the government to deport Saifullah, 34, to his native country and till then he was sent to Central Jail. However, till date formalities to deport him have not been completed.
Meanwhile, the bench of Justice Muhammad Yaqoob Mir directed authorities to file status report by November 25, 2013 about the measures taken for deportation of another Pakistani detainee Qari Muhammad Ismail, of Sindh Pakistan.
On May 21 Justice Mansoor Ahmad Mir had directed Ismail's deportation within two months.
