Court rejects bail plea of accused in kidnapping case

A local court here has rejected the bail plea of a person accused of kidnapping a minor girl.

After hearing the prosecution and the defence counsel, the court of forest magistrate Srinagar MR Chak said the accused doesn’t deserve concession of bail at this stage.

   

“We are living in a civilized society and every woman must be having guarantee to move to and fro without any fear,” the court said.

The court said the accused is involved in the kidnapping of a minor who has been kept in confinement by putting her under fear and therefore the accused at this stage doesn’t deserve concession of bail inasmuch as granting of bail at this stage will definitely place premium upon illegal act of the accused. 

“The bail application filed by the accused is dismissed,” the court ruled. “Statement of the prosecutrix has been recorded by this court and the prosecutrix has fully testified the contents of the FIR. 

“She has stated her age to be about 15 years and same has been got authenticated from Municipal Corporation Srinagar,” the court added.

Earlier, the prosecutor opposed the bail application with vehemence and submitted that accused has committed heinous and non-bailable offences and therefore he cannot claim bail as a matter of right. As per the police, the accused kidnapped the girl on 30 July 2018. The father of girl filed a written application before police station Zaina Kadal after her daughter didn’t return from school.

Upon the receipt of this information, police registered the case and during the course of investigation the accused was arrested and the girl was recovered from his custody on 1 August 2018.
