The High court on Thursday directed Tehsildar (executive Magistrate) Khanyar Srinagar to ensure release of Former Deputy Mayor of Srinagar municipal corporation (SMC), Sheikh Mohammad Imran after securing bond and necessary sureties to his satisfaction.
While hearing a plea by the former deputy Mayor of SMCthrough his counsel Altaf Haqani, a bench of Justice Ali Muhammad Magreydirected the executive magistrate to ensure adherence to the provisions ofSections 107 and 151 of CrPC and ensure release of the detenue.
For ensuring temporary release of the petitioner, the courtasked the Executive Magistrate either approach the Central Jail Srinagar fordoing the needful or ask the Superintendent, Central Jail Srinagar to producethe detenue before him for furnishing the bond.
The direction came after the petitioner’s counsel told the court that since August 5 last year when the petitioner was arrested, the executive magistrate never asked him to furnish bail bonds in terms of compliance and adherence to section 107 and 151 of CrPC.
