Jammu and Kashmir High Court on Thursday quashed the detention of Dukhtaran-e-Milat activist, Sofi Fehmeeda, who was booked under Public Safety Act (PSA) in October this year.
After hearing the parties, a bench of Justice Muzafar Atthar quashed Fahmeeda's detention and directed the government to release her forthwith.
Advocate Advocate Mian Abdul Qayoom who represented Fahmeeda pleaded that the detention order against the detenue was out of sync with the provisions of law while the state counsel defended the government.
"The detenue has been deprived from making effective representation against her detention, which, inturen, has adversely affected her constitutional rights guaranteed under Article 22 (5) of the Constitution of India," the bench said, adding the grounds of detenue's detention were vague. Such vague grounds cannot enable the person to file effective representation against his/her detention," it added, while quashing the detention.
