High Court quashes 6 PSA detentions

Observing that a citizen cannot be deprived of personal liberty out of keeping with law, the High Court has quashed detention of six persons who were booked under Public Safety Act. The court ordered release of these detainees, if they are not required in any other case.    

Pointing out that life and liberty of the citizens of the State are of paramount importance, the court said a citizen cannot be deprived of personal liberty guaranteed to him or her by the Constitution except in due course of law.  

   

“A duty is cast on the shoulders of the Court to enquire that the decision of the Executive is made upon the matters laid down by the Statute, the court said a citizen cannot be deprived of personal liberty, guaranteed to him or her by the Constitution except in keeping with law,” court observed.  

Two Separate benches of the High Court quashed the detentions after hearing Advocate Advocate Shafaqat Nazir on behalf of the detainees and the state government through its counsel.    

The Court quashed detentions of Zahoor Ahmad Lone son of late Muhammad Subhan Lone  of Tantary Pora, Palhallan, Javid Ahmad Lone son of  Abdul  Rahim Lone of Shallapora, Langate, Bashir Ahmad Dar son of Muhammad Ismail Dar of Naseembagh Sopore, Muhammd Saleem son of Ghulam Muhammad War of Warpora Sopore , Farooq Ahmad Bhat son of Abdul Aziz Bhat of Tawheedbagh Sopore .  

The Court also quashed detention of Yawar Muzaffar Bhat son of Muzaffar Ahmad Bhat of Sopore after heraing his counsel,  Advocate Mian Abdul Qayoom .
